Terms and conditions for voucher card

The issuer is Madklubben Catering (hereinafter the Issuer).

The Issuer will always provide the service to which the voucher card (hereinafter the service/service units) gives access.

The purchase/sale agreement for services is entered into between you and the Issuer, your direct and actual contractual partner. The Issuer is responsible for fulfilling the agreement with the consumer and is liable to the consumer for all matters relating to the service.

By accepting these Terms and Conditions, the following is confirmed:

Right of withdrawal
The purchase of a voucher card is, according to Danish consumer legislation, subject to a right of withdrawal of 14 days from the date of purchase. Any claims in connection with non-delivery or defects in the delivered service must be made directly to the Issuer - Madklubben Catering (your direct contractual partner).

If you wish to withdraw from your purchase, you can contact Madklubben by writing to frokost@madklubben.dk or calling +45 78 74 65 06. Please state the unique code when contacting us.

The full amount will be refunded within 3 business days to the same credit card with which the unit was purchased if the withdrawal deadline is met and it is ensured that the unit has not been redeemed.

The voucher card is a bearer instrument.

Both the buyer and the recipient (the person in possession of the voucher card) have the right to withdraw. The 14-day right of withdrawal starts from the buyer's receipt of the voucher card, regardless of whether it is the recipient who exercises the right of withdrawal. If the unit has been redeemed by the buyer or recipient, the right of withdrawal cannot be exercised.

Right of withdrawal
According to the Danish Consumer Contracts Act §18, para. 2, no. 12, you have no right of withdrawal concerning tickets issued for services that are provided on a specific day or within a specific period.

This is relevant for agreements on, among other things:

  • catering, e.g. restaurant visits and food delivery (catering),
  • cultural events, e.g. concerts, theatre performances and sporting events.

Prices and Purchase
You can pay with Dankort, Visa, Visa Electron, MasterCard and MobilePay. An expedition/ticket fee is added, which is clearly stated in connection with your purchase. No card fee is added to your payment if you use a private credit card. A card fee is added to company credit cards and credit cards issued outside the EU.

Payment takes place via a secure connection, where entered information is encrypted so that it cannot be read by others.

All prices are recommended retail prices including VAT. Payment is deducted at the same time as you receive a receipt for your purchase.

When redeeming, the consumer brings the voucher card in the form it was received.

The voucher card is valid for 24 months from the date of issue. The voucher card is valid from the date the goods are purchased - even if you choose a later delivery date for the person who is to receive the voucher card.

Right to Cash Redemption
If the voucher card has been issued free of charge for example sponsorship, charity, competition or part of an advertising campaign, the voucher card is free of charge and cannot be claimed.

If you are a business customer issued to business B2B (not as a consumer according to the Payment Act § 7, para. 1, no. 15), the rule on cash redemption is waived. These cannot be redeemed for cash in or after the validity period according to the Payment Act § 6, para. 2, cf. § 96, para. 2.

Upon cash refund of the voucher card to the consumer within the validity period, a fee of up to DKK 50,- may be charged (for redemption, handling of payment and reconciliation).

Personal data policy
The issuer is the data controller.

The privacy policy in this section describes how the Issuer collects and processes your personal information.

For handling and communication regarding your purchase, as well as any changes/cancellations.
When purchasing a voucher card, your data is stored for 12 months after the device expires. For tickets to events, the information is automatically deleted 36 months after the event has been held.

As a data subject, you have the opportunity to gain insight and to be able to object to a registration, cf. the rules of the General Data Protection Regulation.
By contacting the Issuer in writing, you can gain access to the information registered about you, as well as request that the personal data be deleted.

As a consumer, you are always protected by the applicable legislation in the area according to the Consumer Contracts Act and the Sale of Goods Act.

Information about the possibilities of appeal
complaint about a product or service can be submitted to the Danish Competition and Consumer Authority's Centre for Complaint Resolution, Carl Jacobsens Vej 35, 2500 Valby. You can complain to the Centre for Complaint Resolution via www.forbrug.dk. The European Commission's online complaint portal can also be used when submitting a complaint. This is particularly relevant if you are a consumer residing in another EU country. Complaints are filed here - http://ec.europa.eu/odr. When filing a complaint, you must provide the email address frokost@madklubben.dk.
